This website constitutes the online store for the sale of Tommy Hilfiger products via the internet (hereinafter "the Store") of the limited liability company under the name " SARKK INDUSTRIAL AND COMMERCIAL SA " and the distinctive title "SARKK SA" (with Tax Identification Number 094526950) of the Tax Office of KEFODE ATTIKIS and with the General Registry Number 124189401000) located in Greece, in Halandri, Attica, at 67 Tzavella Street and Mesogeion Street (hereinafter referred to as the "Company" or "SARKK SA"), which operates and manages the physical stores of Tommy Hilfiger.  A. 5338/2018, codified Law 2251/1994), Electronic Commerce (Decree 131/2003) and the Protection of Individuals with regard to the Processing of Personal Data (EU Regulation 2016/679, Laws 2472/1997 and 3471/2006), as currently in force.

Every time you enter, browse and transact with the Store, you become a visitor and/or customer of the Store, as long as you make a transaction. Before proceeding with your browsing within the Store, please confirm that you have fully read and understood these GTC and that you accept them as any use and/or transaction you may henceforth make with the Company through the Store implies your full and unconditional acceptance of these GTC.

The "Privacy Policy" and the "Cookies Policy" are intended to ensure that any personal data collected by cy.tommy.com (hereinafter referred to as the "website") or by the other stores will be protected, used, stored and processed by us for the purpose of communication between us and the provision of services, always in compliance with the applicable legislation on the protection of personal data (Regulation (EU) 2016/679).

ITEMS FOR SALE - PRICES

The products sold by the Store are products of the Company (hereinafter the "Products"). The characteristics and other accompanying data (e.g. indicatively the existence of warranty, the identity, any instructions, etc.) are available and you can find them by following the search instructions listed in the Store and by clicking on the name of the respective product. The prices listed in the relevant catalogues next to each product include VAT (24%). These prices refer to the Products and the quantities that are available in the Company's warehouse, while the Store reserves the right to adjust prices without notice.

GENERAL TERMS AND CONDITIONS FOR THE USE OF GIFT CARD

1. The Electronic Gift Card is valid only in Cyprus for the purchase of any product sold in the online store cy.tommy.com. The Electronic Gift Card is issued by SARKK SA (hereinafter referred to as "the Company" or "SARKK"), which sets the Terms and Conditions of Use at its sole discretion and has the right to modify them at any time.
2. The Company, in order to implement the purpose of the Electronic Gift Card, will have to process personal data of third parties provided by the sender/buyer of the Electronic Gift Card, and in particular the personal data of the recipient of the Electronic Gift Card. If the sender/buyer provides third party personal data, he/she guarantees and is responsible that he/she has informed the recipient of the purposes and manner in which the company must process his/her personal data and has obtained his/her express consent for the disclosure of his/her data, the purpose for which they are given and the manner in which they are processed. The Sender - Buyer is solely responsible for the disclosure and receipt of the aforementioned consent, which he guarantees to the Company that he has. In the event that you have purchased the gift card for a third party, the personal data of the third party that you provide to the Company will be used for the following purposes.
3. The value of the electronic gift card may be paid by any payment method accepted on the cy.tommy.com website. Electronic Gift Cards cannot be purchased using another gift card. No discount code/voucher can be used to purchase a Gift Card.
4. The Electronic Gift Card can be used only once by its holder online at SARKK's eshop (cy.tommy.com). In the case that the purchase price of a product exceeds the available amount of the Electronic Gift Card, the difference can be paid by any payment method accepted, as the case may be in the cy.tommy.com eshop. In the event that the purchase price of a product does not exceed the available amount of the Electronic Gift Card, the order cannot be successfully completed.
5. The Electronic Gift Card is valid for 6 months from the date it is sent to the intended recipient. After the expiry of the validity period, the Electronic Gift Card cannot be used to purchase products. Likewise, it shall not be extended prior to its expiry.
6. The holder is solely responsible for the use and safekeeping of the gift card. The electronic gift card cannot be replaced in case of theft of its code and/or unauthorized use, loss or destruction.
7. SARKK is not responsible for non-receipt or delay in sending this electronic Gift Card by the intended recipient for reasons beyond SARKK's control, including but not limited to the following cases: (a) defects or failures of telecommunication, internet and e-mail lines/systems; (b) delay in retransmission of information or data or the loss of information or data that may occur under the circumstances set forth above under letter (a), c) inaccuracy of the data of the recipient of the Electronic Gift Card provided by the sender/buyer of the Electronic Gift Card, or the fact that the e-mail address sent by SARKK may be considered as spam or junk e-mail e) the recipient has chosen not to receive the Electronic Gift Card
8. Electronic or other gift cards (e.g. credit invoices) that have been obtained from the outset in any way other than as described in these Terms of Use are null and void and cannot be used to purchase products
9. The return of any electronic Gift Card, assuming that it has not yet been used, is accepted, subject to the following conditions: An Electronic Gift Card purchased through cy.tommy.com may be cancelled within 14 DAYS of the date of purchase and shipped to its intended recipient. The purchaser's withdrawal must be communicated in writing to SARKK either by telephone to the Customer Service Department or by email on the e-shop site. The refund time varies depending on the Bank and the type of credit card. In this case, the use of the card is cancelled and the recipient is not entitled to use it.
10. An electronic gift card acquired in any other country or through the online store, but accessed from another country, cannot be used on cy.tommy.com. The respective balance of the Gift Card is not refundable or exchangeable for cash
11. In case of a total return of an order according to the General Terms and Conditions of Sale of the online store that has been placed through the online store cy.tommy.com and an electronic gift card has been used, the return is processed in the same way as the purchase has been made. Money is refunded to the customer for the part of the transaction that was paid for and for the amount covered by the electronic gift card, the customer is refunded a credit of the same value, which can be used in his/her next order.
12. In case of partial return of an order according to the General Terms and Conditions of the online store that has been submitted through the online store cy.tommy.com and an electronic gift card has been used, the refund to the customer is always preceded and if there is part of the transaction that was covered with an electronic gift card, the customer is refunded a credit of corresponding value which can be used in his next order.
13. The credit vouchers resulting from the above will be sent by e-mail to the e-mail address of the customer who made the return of the purchase with the electronic gift card. The customer is solely responsible for the validity of the e-mail address provided.
14. In case a customer refuse to accept the delivery an order placed through the online store cy.tommy.com which has an electronic gift card in the payment method, then the gift card code is reactivated for use in the next order and the validity date remains the same as the one originally issued, i.e. six months.

    Purchase and/or use of the Gift Card implies full acceptance of the above terms and conditions, which are available on the cy.tommy.com.

ADVERTISING MESSAGES

The Store provides the opportunity for you, its visitors/customers, to choose to be informed about the Company's new products and other offers and services of the Company by sending promotional - informative messages to the e-mail or postal address or telephone number you have requested. The Store will not under any circumstances misuse the above mentioned service. You are always given the possibility to discontinue this service by sending a request to cs.cy@tommy.com

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

Except for the expressly stated exceptions (copyright of third parties, partners and entities), the entire content of the website, including images, graphics, photographs, drawings, texts, the overall appearance, the services and Products provided and in general all the files of the Store are the intellectual property, industrial designs, distinctive signs, marks, symbols, signs and registered trademarks and service marks of the Company, its affiliated companies and enterprises and its suppliers, as well as of the Company, its affiliated companies and enterprises and its suppliers. Any other products or services that may be mentioned in the Store and bear the trademarks of their respective organizations, companies, affiliates, partners, entities, associations or publications are their intellectual and industrial property and therefore they are responsible for them.

RESPONSIBILITY OF THE PARTIES

As a visitor/customer, by accepting these GTC and browsing the Store, you declare responsibly that you are legally able to enter into this agreement, as well as to use the Store under the terms and conditions stated herein.

APPLICABLE LAW AND OTHER CONDITIONS

The Company and the Store reserve the right to amend or renew these GTCs in writing without notice, which shall be effective as of the date of their posting in the Store. Failure to exercise any right of the Company shall not be construed as a waiver thereof.
It is expressly provided that Greek law is applicable. For any dispute that may arise from these Terms and Conditions, the Courts of Athens are agreed to be exclusively competent.

ALTERNATIVE DISPUTE RESOLUTION

The Company, in compliance with Community and national legislation regarding the alternative resolution of consumer disputes, informs you of the possibility of out-of-court settlement of any dispute related to your transactions with the Store through the alternative dispute resolution bodies listed here by country.
